1) ELIGIBILITY: The Holiday Instant Win Game (the "Promotion") is open only to legal residents of the fifty (50) United States and District of Columbia (excluding residents of New York, Rhode Island and Puerto Rico and all other U.S. territories and possessions) who are 21 years of age or older at the time of entry. Void in New York, Rhode Island, Puerto Rico and other U.S. territories and possessions and where prohibited by law. Employees of Cost Plus, Inc. (“Sponsor†or “Cost Plus World Marketâ€), Haley Miranda Group, Inc. (“Administratorâ€), and their respective parents, affiliates, subsidiaries, retailers and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, children and each of their respective spouses, regardless of where they reside) and household members of each such employee, whether related or not, are not eligible to enter or win. The Promotion is subject to all applicable federal, state, and local laws and regulations.
2) TIMING: The Promotion will take place during regular business hours at participating Cost Plus World Market stores on 11/27/09 and 11/28/09, or while supplies last, whichever is first (the “Promotion Periodâ€).
3) HOW TO PLAY: During the Promotion Period, the first one hundred (100) eligible visitors (as determined by Sponsor) to visit any participating Cost Plus World Market store during regular business hours will receive a free specially marked game piece for the chance to win a $10,000 Visa gift card. All other eligible visitors who visit any participating Cost Plus World Market store during regular business hours after the first one hundred (100) eligible visitors will receive a free specially marked game piece for the chance to win a $5,000 Visa gift card, a $2,500 gift card, or a $5 off coupon, while supplies last. Scratch off where indicated on the game piece to see if you are an instant winner. Limit one (1) game piece per person and per household and per store per day. Game pieces obtained through unauthorized channels or that have been altered or tampered with are void.
4) WINNER PRIZE CLAIMS AND VERIFICATION: All prize awards are subject to verification of eligibility, game piece and compliance with the terms of these Official Rules. Grand Prize (1): If your game piece indicates that you have won a $10,000 Visa gift card, you are the Grand Prize winner, subject to verification of eligibility, game piece and compliance with the terms of these Official Rules. First Prize (1): If your game piece indicates that you have won a $5,000 Visa gift card, you are the potential First Prize winner, subject to verification of eligibility, game piece and compliance with the terms of these Official Rules. Second Prize (1): If your game piece indicates that you have won a $2,500 Visa gift card, you are the potential Second Prize winner, subject to verification of eligibility, game piece and compliance with the terms of these Official Rules. If you are a Grand, First or Second Prize Winner, to redeem your prize, sign the game piece and mail the original signed game piece along with a 3†x 5†card with your complete name, address, date of birth, daytime and evening phone numbers (with area code), and email address (optional) via overnight delivery service (e.g., FedEx or UPS) or CERTIFIED MAIL, RETURN RECEIPT REQUESTED ONLY to: CPWM’s Holiday Instant Win Game PRIZE CLAIM, c/o Haley Miranda Group, 8654 Washington Blvd., Culver City, CA 90232. Retain a photocopy of the signed game piece for your records. Proof of mailing does not constitute proof of delivery. All Grand, First and Second Prize claims must be received by 12/7/09 or prize will be forfeited in its entirety. Third Prize (107,600): If your game piece indicates that you have won a $5 off coupon, you are an Instant Win Redeemable Prize Winner, and may redeem your prize instantly in the participating Cost Plus World Market store on 11/27/09 or 11/28/09. Instant Win Redeemable Prizes not redeemed by close of business on 11/28/09 will be void. All prize claims are subject to verification by Haley Miranda Group (“Administratorâ€), an independent judging organization whose decisions are final and binding in all matters relating to the Promotion. Odds of being one of the first one hundred (100) visitors to any participating store depends on the number of eligible visitors. Odds of game card recipient winning the Grand Prize: 1:26,900. Odds of game card recipient winning the First Prize: 1:91,125. Odds of winning the Second Prize: 1:91,125 Odds of game card recipient winning the Instant Win Redeemable Prizes: 107,603:209,150. You are not an instant winner if your game piece does not indicate you have won a prize.
Once the Administrator has received the signed game pieces for verification, potential Grand Prize, First Prize and Second Prize winners will be notified by phone or email and will be required to execute and return an affidavit of eligibility/liability release, tax form where applicable and, where legal, a publicity release (collectively, the “Eligibility Documentsâ€) within seven (7) calendar days of date of issuance. If a potential winner cannot be reached within two (2) calendar days from the first notification attempt, or in the event of noncompliance within the above stated Eligibility Documents time period, with these Official Rules, or if any prize or prize notification is returned as undeliverable, prize will be forfeited. All game pieces and prize claim materials become the property of the Sponsor and will not be returned. In the event that a Grand, First or Second Prize is unclaimed by 12/7/09 or if a potential winner cannot be verified, the applicable prize will be forfeited and no alternate winner(s) will be selected.
5) PRIZES: Grand Prize (1): A $10,000 Visa gift card. Approximate Retail Value (“ARVâ€) of Grand Prize: $10,000.
First Prize (1): A $5,000 Visa gift card. ARV: $5,000.
Second Prize (1): A $2,500 Visa gift card. ARV: $2,500.
Four Hundred (400) Third Prizes per participating store (up to 269 stores): Four hundred (400) $5 Cost Plus World Market coupons (ARV of each: $5). All Third Prizes must be redeemed in the participating Cost Plus World Market store at which the game piece was obtained by 11/28/09. Coupons are subject to terms and conditions specified thereon.
General Prize Conditions: Gift cards are subject to certain terms and conditions specified by Visa. All prize details are at the sole discretion of the Sponsor. No substitution, assignment, cash equivalent or transfer of prizes is permitted, except by Sponsor, who reserves the right to substitute a with another prize of comparable or greater value, at its sole discretion. The total maximum ARV of the prizes in the Promotion: $555,500.
6) TAXES AND EXPENSES: Winners are solely responsible for all federal, state, and local taxes (if any) and other fees and expenses associated with prize receipt and use not specified herein as being awarded.
7) CONDITIONS OF ENTRY: By participating, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor and Administrator, which are final and binding in all matters related to the Promotion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with or subverting the participation process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner and void all associated prize claims.
8) GENERAL CONDITIONS: By participating, the entrants consent to the use of their names, cities and states of residence, voices, and/or photographs and/or similar related information for promotional, advertising and other purposes in any and all media now or hereafter known throughout the world in perpetuity by Sponsor and its designees, without additional compensation, notification or permission, except where prohibited by law. Entrants agree to release and hold harmless Sponsor, Administrator, and their respective parent companies, affiliates, subsidiaries, divisions, suppliers, distributors, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees, and agents (collectively, “Releaseesâ€) from any claims, actions, injury, loss or damage of any kind resulting from participating in this Promotion or from the acceptance, use of any prize awarded.
9) LIMITATIONS OF LIABILITY: Only the number of prizes stated herein will be awarded. Releasees are not responsible for: (i) unauthorized human intervention in any part of the participation process; (ii) late, lost, stolen, undelivered, misdirected, delayed, inaccurate, illegible, or incomplete prize claims or postage-due mail, lost or stolen game pieces, or for any printing, typographical, human or other error relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing of prize claims, the announcement of prizes or in any Promotion-related materials; or (iii) any injury or damage to persons or property, which injury or damage may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion. Sponsor reserves the right to cancel or modify the Promotion if fraud, or any other factor impairs the integrity of the Promotion (or portion thereof), as determined by Sponsor in its sole discretion. Promotion materials are void if not obtained through authorized, legitimate channels, or if any part is defective, altered, duplicated, photocopied, forged, counterfeited, mutilated or tampered with in any way, or if Promotion materials contain or are the result of printing, seeding, human, electronic, computer, typographical, mechanical or other errors, or do not contain proper security devices. In the event of printing, seeding or other errors where more valid, eligible claims are received for any prize than set forth in these Official Rules, Sponsor reserves the right to combine all such claims in a random drawing to award the advertised number of prizes for the prize at issue. Sponsor reserves the right to terminate/cancel the Promotion if technical, printing, or other errors or problems compromise the integrity of the Promotion.
10) DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Promotion, and in no event shall entrant be entitled to receive attorneys’ fees or other legal costs or expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California.
